Employment Standards Compliance

In Ontario, the Employment Standards Act, 2000 (the “ESA”) is legislation that sets out basic employment rights and protections, including:

  • Overtime pay
  • Vacation
  • Hours of work
  • Public holidays
  • Pregnancy and Parental Leave
  • Caregiver leave to care for an ill or injured family member
  • Sick Leave
  • Reinstatement rights
  • Protections against reprisal

All provincially regulated employers must comply with the requirements of the ESA. If you work for a federally regulated employer, such as a bank, airline, telecom provider, broadcaster, then you are subject to the Canada Labour Code. The Canada Labour Code contains similar employment standards entitlements and protections.

JPak Employment Lawyers have advised and have successfully represented clients with respect to employment standards violations, at the Ministry of Labour, the Ontario Labour Relations Board and in court proceedings.
