How is severance compensation determined?

 

One’s severance entitlements generally are influenced by the following factors considered by the Courts:

    • Age at termination
    • Character of employment
    • Length of service
    • Annual compensation at the time of dismissal
    • The availability of comparable jobs in the labour market.

Generally, severance increases with factors such as the age of the employee, seniority, and level of position. How do you calculate severance pay?

Termination payouts for employees is, at minimum, calculated based upon an employee’s entitlements under the relevant employment standards legislation. In Ontario, for provincially regulated employees, termination payments are prescribed by the Employment Standards Act, 2000 (“ESA”). For example, the ESA will state what notice of termination or pay in lieu, benefits continuation, vacation pay, statutory severance pay etc. an employee is to receive when their employment is terminated. However, employees may have greater entitlement to notice and pay based on their overall compensation at common law. Calculating common law entitlement depends upon the situation. Relevant factors that are considered to determine the common law notice period include but are not limited to: the employee’s age, how long they worked for the employer, the nature of their job, whether they had managerial responsibilities, salary, the manner of termination, and challenges they may face securing comparable work.
